This information helps us customize your bid process for properties offered on the site, and is a security for the transaction. You must review and accept the terms and conditions of this policy and indicate your consent and understanding of the terms on the registration form in order to participate in the bid program.
Fraud occurs on even the most secure sites, and use of Auction Co. website is at your own risk. By completing the registration form, you acknowledge that you are aware of security and privacy limitations, including but not limited to: security, privacy and authentication measures and features in this system; that data or information on the service may be subject to eavesdropping, sniffing, spoofing, forgery, spamming, “impostering”, tampering, breaking passwords, harassment, viruses, worms, and Trojan horses, which can cause unauthorized, harmful or damaging access or retrieval of information and data on your computer, as well as other security or privacy hazards; and that data or information may not reach its destination or may reach an erroneous address or recipient; and agree to hold the Auction CO. harmless for any actual or consequential loss or damages related to the aforementioned privacy and security limitations or breach thereof.

The Auction Co. makes no warranty that the services provided on this site will meet the requirements of an individual User, will be uninterrupted, timely, secure or error free; nor does the Auction Co. make any warranty as to the results that may be obtained through the use of this site or as to the accuracy or reliability of information obtained from this site, or that defects in software will be corrected. No advice or information, whether oral or written, obtained by a User from The Auction Co. or any of it’s employees, representatives or affiliates, or through the site, shall create any warranty not expressly made herein.
In no event shall the Auction Co. or any of it’s employees, representatives or affiliates be liable to a User or any other person or entity in connection with this agreement for any actual, special, consequential, incidental or reliance damages, or any loss of revenue, profits or data; however caused, whether for breach of contract, negligence or under any other legal theory, whether foreseeable or not and whether or not a user has been advised of the possibility of such damage and notwithstanding the failure of essential purpose of any limited remedy. All parties agree that these limitations of liability are agreed allocations of risk and are reflected in the mutual benefit and consideration derived by the utilization of this site. Further, the User agrees to indemnify and hold harmless THE AUCTION CO. against any and all claims arising out of the limitation of liability contained herein.
Auction Site User Agreement
This is a legal agreement between you, the user or buyer, and The SITE OWNER or Auction Co.
Detroit Property Exchange. and/or Partners (hereinafter referred to as the Auction Co.) at its sole discretion, may ban from further use any buyer or seller which Auction Co. believes to have in any way misrepresented itself or any item selling, failed to abide by the terms, or conducted any improper auction behavior as determined solely by theDPX. Any seller who misrepresented their items and any buyer who improperly fails to carry thru with a purchase will be banned from any further use and may be subject to additional legal actions.
NON REFUNDABLE DEPOSIT: Auction Co. RESERVES THE RIGHT to charge $500.00 onyour credit card on your purchase or your total purchase(s) immediately following the sale. The Balance will be due within five business days and prior to removal, payable by cashiers check, cash, credit card, or wire transfer. Note that the purchase price is the sum of the bid price, buyers premium, and buyer's fee if applicable. All payments must be in U.S. Funds. Auction Co. reserves the right to charge any remaining balance of your purchase price on your credit card it the balance is not paid within 7 days.
Terms: All items sell AS IS WHERE IS with no warranty of any type expressed or implied as to the merchantability or fitness for any particular purpose of any properties in this sale. All sales are made on an AS IS - WHERE IS basis with all faults. All buyers are urged to physically inspect the property during the open house period. No bids can be withdrawn after the auction for any reason. BUYER agrees that these terms as well as all other terms set forth below, can be amended or revised only in writing, signed by the auctioneer. BUYER understands that any description given in the website or at the property is not guaranteed, and BUYER will rely entirely on their own inspection. All information and descriptions contained in advertising this sale are believed correct, but no responsibility is assumed by Auction Co. for any errors or omissions.
Posted closing times and displays of Auction Co.'s current time are approximate. Auction Co. reserves the right to close early or extend auctions at any time at its discretion. It is strongly recommended that bids be placed early to avoid losing out due to an ill-timed, last minute bid. All times are Detroit MI, time. Dynamic bidding - The dynamic bid on this website is a feature that does NOT allow an item to sell at the end of the auction until there is 10 minutes of bidding inactivity. Example - An item is bid on at 7:50pm. An auction is scheduled to close at 8:00pm. When this bid is placed the ending time will automatically extend to 8:10pm. When another bid is place at 8:01 the auction will extend until 8:20pm. This will give bidder 19 minutes to place another bid. If no bids are placed this auction will conclude at 8:20pm. The key to your dynamic bidding feature is that the auction extends from the preset closing time in 10 minute intervals, NOT 10 minutes from when you placed your bid.
